Newark and Sherwood District Council are staying committed to 100 affordable homes development on Yorke Drive




A condition requiring affordable housing to be a part of planning consent for the redevelopment of the Yorke Drive estate, Newark, has been dropped on legal advice ­— but the homes will be delivered.

Rob Main, of Newark and Sherwood District Council, which is the applicant, said: “At the planning committee held on November 5, the outline planning application for the Yorke Drive regeneration proposals was formally approved.

“Prior to this the district council sought legal advice to ensure all the necessary outcome of conditions attributed to the planning application will be delivered by the proposals.

“This is because the council, as the local planning authority, cannot enter into a Section 106 legal agreement with itself.

“Based on this advice, the committee made all matters relating to open space/children’s play area, outdoor sports facilities, education, community facilities and transport, a condition of the planning decision rather than part of a Section 106 agreement.

“The affordable housing requirement was removed from the planning decision, as the council has already clearly demonstrated its intent and commitment, through a number of earlier council committee decisions, to the delivery of 100 new council affordable homes.”

Mr Main said the commitment to 100 affordable homes was unchanged.
